Sir:

 

     Your Committee on Labor & Public Employment, to which was referred H.B. No. 1698 entitled:

 

"A BILL FOR AN ACT RELATING TO COLLECTIVE BARGAINING,"

 

begs leave to report as follows:

 

     The purpose of this measure is to establish separate bargaining units for:

 

     (1)  State law enforcement officers; and

 

     (2)  State and county ocean safety and water safety officers,

 

by retaining state law enforcement officers under Bargaining Unit (14) and creating a Bargaining Unit (15) for state and county ocean safety and water safety officers.

 

     Your Committee received testimony in support of this measure from the City and County of Honolulu; Hawaii Government Employees Association, AFSCME Local 152, AFL-CIO; Hawaiian Lifeguard Association; North Shore Lifeguard Association; and several individuals.

 

     Your Committee finds that Bargaining Unit (14) currently comprises deputy sheriffs, conservation and resource enforcement officers, harbor enforcement officers, and county ocean and water safety officers, which results in a bargaining unit made up of two occupational classes with different needs and job functions.  Providing separate bargaining units for law enforcement officers and ocean safety and water safety officers will better address the distinct job duties and needs of these employees, while keeping the same voting composition for purposes of negotiating collective bargaining agreements.

 

     Your Committee has amended this measure by changing its effective date to January 1, 2050, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Labor & Public Employment that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1698, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1698, H.D. 1, and be referred to your Committee on Finance.
