Sir:

 

     Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 141, H.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO HEALTH,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Require public schools and public charter schools to have at least one employee trained to administer seizure rescue medication, except under certain circumstances;

 

     (2)  Require a seizure action plan for every student diagnosed with a seizure disorder and distribution of the plan to employees charged with supervising the student; and

 

     (3)  Require all principals, guidance counselors, and teachers to perform an annual self-study review of seizure disorder materials.

 

     Your Committee received testimony in support of this measure from the Epilepsy Foundation of Hawaii, Epilepsy Foundation of America, Hawaii Primary Care Association, and numerous individuals. Your committee received comments on this measure from the Department of Education.   

 

Your Committee finds that this measure is based on model legislation proposed by the national Epilepsy Foundation to increase the public's awareness of seizure disorders and make schools safer for students affected by seizure disorders.  Your Committee further finds that this measure is a critical priority for the epilepsy community and is needed to promote safety and continuity of care in the event of a seizure.  Your Committee also finds that this measure contains important protections necessary to enhance the safety of Hawaii's students living with seizure disorders while they are attending school.

 

     As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 141, H.D. 2, and recommends that it be referred to your Committee on Finance.
