A BILL FOR AN ACT

 

 

Relating to Education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding two new sections to part VI to be appropriately designated and to read as follows:

     "§302A-    Emergency preparedness; safety and security.  To ensure the safety of students, teachers, and school staff:

     (1)  All classroom doors shall be equipped with an interior lock no later than January 1, 2020;

     (2)  All interior and exterior locations on school property, including but not limited to classrooms, workrooms, teacher lounges, playgrounds, gymnasiums, auditoriums, cafes, and any gathering places on school property, shall be connected to an intercom system capable of audible and visual communications between a main location and satellite locations; and

     (3)  All school perimeters not secured by a physical barrier shall be monitored via security cameras or security personnel.

     §302A-    Emergency management plan; emergency preparedness.  (a)  The department may establish an emergency management plan aligned with federal recommendations as outlined in the Guide for Developing High-Quality School Emergency Operations Plans published by the United States Department of Education, or its successor publication, for all schools to prepare for and respond to an emergency or a disaster as defined in section 127A-2.  Emergency management plans shall be updated on an annual basis and shall include:

     (1)  Mandatory emergency preparedness training for all teachers, students, and school staff that includes:

          (A)  Annual training for all teachers and staff on violence prevention, awareness, reporting, and emergency response conducted in conjunction with law enforcement;

          (B)  Annual, age-appropriate training for all students on violence prevention, awareness, reporting, and emergency response;

          (C)  Teacher, staff, and student training on the protocol for initiating an emergency response;

          (D)  Teacher, staff, and student training on a standardized emergency response protocol; and

          (E)  Basic safety training such as first aid and cardiopulmonary resuscitation for all teachers and security personnel; and

     (2)        emergency practice drills per year at each school, some of which shall occur during inopportune times of the school day such as recess or during a school assembly.

     (b)  For the purposes of this section, "law enforcement" means sheriffs, deputy sheriffs, or police officers."

     SECTION 2.  (a)  No later than July 1, 2020, the department of education shall establish and implement a school safety facial recognition pilot program to:

     (1)  Assess facial recognition technology options available with assessment criteria including but not limited to race and ethnic neutrality, privacy, security, and price;

     (2)  Explore the safety benefits of including staff, students, and visitors in the facial recognition database;

     (3)  Test facial recognition technology in a suitable school location with the goal of enhancing school safety;

     (4)  Gauge reception of the program by staff, students, and the public at the beginning of facial recognition technology implementation and at the end of the pilot program; and

     (5)  Assess the expense of maintaining facial recognition technology on a statewide scale.

     (b)  The pilot program shall cease to exist on June 30, 2022.

     (c)  The department of education shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2022.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for the purposes of this Act.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2019.

Description:

Requires the Department of Education to equip all classroom doors with interior locks by January 1, 2020, to connect all interior and exterior school locations via intercom, and to monitor all school perimeters not secured by a physical barrier.  Authorizes establishment of an emergency management plan aligned with federal guidelines for all schools to prepare for and respond to an emergency or a disaster.  Establishes a school safety facial recognition pilot program.  Appropriates funds for purposes of this Act.
