A BILL FOR AN ACT
relating to automobiles.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 286-26, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:
"(b) All other vehicles, including motorcycles,
mopeds, trailers, semitrailers, and pole trailers having a gross vehicle weight
rating of 10,000 pounds or less, and antique motor vehicles as defined in
section 249-1, except those in subsections (c) and (d), shall be certified as
provided in subsection (e) every twelve months; provided that any vehicle to
which this subsection applies, except a moped, shall not require inspection
within two years of the date on which the vehicle was first sold. As part of the inspection as provided in subsection (e),
all gasoline powered passenger vehicles
shall be certified every twenty-four months to have an acceptable emissions
level as prescribed by the director under subsection (g), provided that any passenger
vehicle that was manufactured prior to 1975 or within five years of the date of
the certification required by this section, shall not be required to meet the prescribed
emissions levels. Passenger vehicles privately
shipped to the State from the continental United States shall also be required to
have an acceptable emissions level.
For the purposes of this section,
"passenger vehicle" means any motor vehicle with at least four
wheels, used for the transport of passengers, and comprising no more than eight
seats in addition to the driver's seat."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
