A BILL FOR AN ACT

 

 

relating to harassment.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§711-    Indecent harassment.  (1)  A person commits the offense of indecent harassment if, without consent and with the intent to arouse or gratify the sexual desire of any person, the person:

     (a)  Exposes or attempts to expose another person's genitals, pubic area, anus, buttocks, or female areola; or

     (b)  Causes another person to contact the blood, seminal fluid, vaginal fluid, saliva, urine, or feces of any person.

     (2)  Indecent harassment is a misdemeanor."

     SECTION 2.  Section 571-14, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The court shall have concurrent jurisdiction with the district court over violations of sections 707-712, 707-717, 707-722, 708-822, 708-823, 710-1010.5, 711-1106, [and] 711‑1106.5, and 711-   when multiple offenses are charged through complaint or indictment and at least one offense is a violation of an order issued pursuant to chapter 586 or a violation of section 709-906."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
