A BILL FOR AN ACT
RELATING TO SCHOOL MEALS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- Plant-based food and beverage program. (a) The department of education shall develop and implement a plant-based food and beverage program.
(b) Subject to available funds, the plant-based
food and beverage program shall award participating public schools up to
$ in quarterly
allotments for providing meals that include a plant-based food option or
plant-based milk option, or both, pursuant to this section.
(c) Subject to available funds, the department
may limit the total amount of awards provided to participating public schools
pursuant to this section to a total of
$ per year.
(d) Any public school applying to participate in
the plant-based food and beverage program shall provide the department of
education with documentation of the number of plant-based food options and
plant-based milk options under the federal National School Lunch Program that
the school served in the 2019-2020 school year.
A public school that does not provide this documentation shall not be
eligible for the plant-based food and beverage program.
(e) The awards described in subsection (b) shall be
awarded for plant-based food options and plant-based milk options that
represent an increase from the number of plant-based food options or
plant-based milk options served in the 2019-2020 school year, as demonstrated
by the documentation required pursuant to subsection (d).
(f) Participation in the plant-based food and
beverage program by a public school shall be voluntary. Awards for participating in the plant-based
food and beverage program shall be in addition to any other state or federal funding
or reimbursement received by participating public schools.
(g) The department of education shall adopt rules
pursuant to chapter 91 to carry out the purposes of the plant-based food and
beverage program, including but not limited to:
(1) The award rates per meal that include a plant-based food option or plant-based milk option, or both;
(2) The application process for public schools; and
(3) The meal verification process for participating public schools.
(h) For the purposes of this section:
"Plant-based
food option" means a food that contains no animal products or byproducts,
including meat, poultry, fish, dairy, or eggs, and that is recognized by the
United States Department of Agriculture as a meat alternate for purposes of the
federal National School Lunch Program.
"Plant-based milk option" means a beverage that contains no animal products or byproducts, including dairy, and that is recognized by the United States Department of Agriculture as a nondairy fluid milk substitute for purposes of the federal National School Lunch Program."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2020-2021 for the department of education to develop and implement the plant-based food and beverage program, including but not limited to the following:
(1) Contracting with third parties for professional development training for school staff on serving, including preparing, procuring, advertising, and creating menus for plant-based food options or plant-based milk options;
(2) Purchasing cafeteria equipment to prepare plant-based food options or plant-based milk options, as needed; and
(3) Providing technical assistance and student engagement and education on plant-based food options and plant-based milk options, including providing taste tests, recipe development, and culinary education.
The sum appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
