A BILL FOR AN ACT
RElating to underground storage tanks.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that action is needed to protect Hawaii's groundwater from contamination. Large capacity underground storage tank systems pose a threat to the potability of the State's groundwater.
The purpose of this Act is to prohibit the operation of large capacity underground storage tank systems mauka of the underground injection control line, beginning January 1, 2028.
SECTION 2. Chapter 342L, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342L- Underground storage tank system; underground injection control line; prohibition. Beginning January 1, 2028, no person shall operate an underground storage tank system that has a capacity of 100,000 gallons or more, mauka of the underground injection control line.
For
purposes of this section:
"Underground
injection control line" means the line on the department of health underground
injection control program maps which separates, in plan view, exempted aquifers
and underground sources of drinking water.
"Underground
injection control program" means the program established pursuant to section
340E-2.
"Underground
source of drinking water" means an aquifer or its portion that:
(1) Supplies any public or private
drinking water system or contains a sufficient quantity of ground water to
supply a public water system; and
(A) Currently supplies drinking water
for human consumption; or
(B) Contains fewer than ten thousand
milligrams per liter total dissolved solids; and
(2) Is not an exempted aquifer."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
