A BILL FOR AN ACT
relating to law enforcement.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that, due to recent protests related to projects in Hawaii county and the city and county of Hawaii, the State and counties have spent a significant amount of resources on law enforcement services to ensure the public's safety. According to the Honolulu Star Advertiser, from July 2019 to October 2019, the State and counties have spent at least $8,300,000 on law enforcement costs related to the Thirty Meter Telescope project on Mauna Kea. Additionally, law enforcement services are being used for the ongoing construction of the Na Pua Makani wind turbine project located in Kahuku, Oahu.
The legislature further finds that controversial developments that face prolonged public opposition and require extraordinary police protection should be cognizant of financial and staffing costs. These projects should share in the extraordinary expenses expended on their behalf.
The purpose of this Act is to allow any county to recover a portion of the costs of providing law enforcement services by collecting up to fifty per cent of costs associated with providing law enforcement services for the construction of a project from the developer of the project.
SECTION 2. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Law enforcement
services; projects; costs. (a) Notwithstanding
any law to the contrary, any county may collect up to fifty per cent of costs associated
with providing law enforcement services for the construction of a project from the
developer of the project; provided that law enforcement services were provided by
the county in the furtherance of ensuring public safety and are provided for more
than five days.
(b) Any
county that collects up to fifty per cent of costs associated with providing law
enforcement services pursuant to subsection (a) shall invoice the costs to the developer
of the project after the fifth day of providing law enforcement services.
(c) The
developer of a project shall pay for the cost of law enforcement services provided
by the county pursuant to this section within thirty days of receiving the invoice
from the county."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
