A BILL FOR AN ACT
RELATING to Renewable Energy.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§196- Solar energy devices installation; parking spaces. Beginning July 1, 2020, no permit shall be issued for a new parking lot or structure that does not include installation of solar energy devices over parking spaces to the maximum extent practicable. As used in this section, "solar energy device" means any new identifiable facility, equipment, apparatus, or the like which makes use of solar energy for heating, cooling, or reducing the use of other types of energy dependent upon fossil fuel for its generation."
SECTION 2. Section 291-71, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) Places of public accommodation with [at
least one hundred] parking spaces available for use by the general public
shall have at least [one] ten per cent of parking [space] spaces
by July 1, 2020, fifty per cent of parking spaces by July 1, 2025, and seventy-five
per cent of parking spaces by July 1, 2030, exclusively for electric
vehicles and equipped with an electric vehicle charging system [located
anywhere in the parking structure or lot by July 1, 2012]; provided that no
parking space designated for electric vehicles shall displace or reduce accessible
stalls required by the Americans with Disabilities Act Accessibility
Guidelines. Spaces shall be designated,
clearly marked, and the exclusive designation enforced. [Owners of multiple parking facilities within
the State may designate and electrify fewer parking spaces than required in one
or more of their owned properties; provided that the scheduled requirement is
met for the total number of aggregate spaces on all of their owned properties.]"
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
