A BILL FOR AN ACT
proposing an amendment to article ix, section 6, of the hawaii state constitution, to require the state AND ITS POLITICAL SUBDIVISIONS to PLAN TO produce ENOUGH housing to meet demand in its management of population growth.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Article IX, section 6, of the Constitution of the State of Hawaii is amended to read as follows:
"MANAGEMENT OF STATE POPULATION GROWTH
Section 6. The State and its political subdivisions, as
provided by general law, shall plan and manage the growth of the population to
protect and preserve the public health and welfare[;], which shall include
the production of enough housing to meet demand; except that each political
subdivision, as provided by general law, may plan and manage the growth of its
population in a more restrictive manner than the State."
SECTION 2. The question to be printed on the ballot shall be as follows:
"Shall the State and its political subdivisions be required to plan to produce enough housing to meet demand in its management of population growth?"
SECTION 3. Constitutional material to be repealed is bracketed and stricken. New constitutional material is underscored.
SECTION 4. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
