A BILL FOR AN ACT
RELATING TO EXECUTIVE PARDONS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 353, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§353- Pardons;
application process. (a) An
application for pardon shall be addressed to the governor and filed with the
Hawaii paroling authority. Each application
for pardon shall contain:
(1) The first and last
name of the applicant;
(2) A brief history
of the case or cases for which pardon is being sought;
(3) Any reason for
seeking pardon; and
(4) Any other
relevant information that the Hawaii paroling authority may require.
(b) For each offense for which an applicant is seeking
pardon, the Hawaii paroling authority shall notify the
prosecuting attorney of the county in which the offense occurred. Upon
receiving notification, the
prosecuting attorney of the county in which the offense occurred shall make
reasonable efforts to contact any victim, or victim's immediate family members,
involved in each offense for which pardon is being sought."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2020.
