A BILL FOR AN ACT

 

 

RELATING TO PUBLIC HOUSING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  (a)  In accordance with any applicable federal laws, rules, and regulations, the Hawaii public housing authority shall develop, implement, and administer a rent-to-own pilot program for tenants occupying a dwelling unit or living quarters in a public housing project or state low-income housing project as defined in section 356D-51, Hawaii Revised Statutes.

     (b)  Under the rent-to-own pilot program, the Hawaii public housing authority shall establish the sales price of the unit at the beginning of pilot program and credit a portion of the rent received from a participant toward the purchase of the unit; provided that no portion of the rent received from a participant prior to the start of the pilot program shall be credited toward the purchase of the unit.  The participant shall have the option of purchasing the unit at the designated sales price at any point in time during the duration of the pilot program.

     (c)  Participation in the rent-to-own pilot program shall be voluntary.

     (d)  The Hawaii public housing authority shall designate certain new public housing projects or new state low-income housing projects for participation in the pilot program.

     (e)  Prior to establishing the pilot program and whenever applicable, the Hawaii public housing authority shall consult with the United States Department of Housing and Urban Development and shall adopt rules in accordance with chapter 91 for the purposes of administering the rent-to-own pilot program.

     SECTION 2.  The Hawaii public housing authority shall submit a report regarding the rent-to-own pilot program to the legislature no later than twenty days prior to the convening of the regular sessions of 2021, 2022, 2023, and 2024.

     SECTION 3.  This Act shall take effect on July 1, 2020, and shall be repealed on June 30, 2023.
