A BILL FOR AN ACT
RELATING TO MOBILE ELECTRONIC DEVICES.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 481B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§481B- Mobile electronic devices; retailers;
retail disclosure requirement. (a) Each mobile electronic device retailer shall
post written notice at the time of sale of a mobile electronic device, which shall
be easily visible to customers and contain the following language:
(1) "It is
illegal to use a mobile electronic device while operating a motor vehicle.";
(2) "It is
illegal for a person under eighteen years of age to utilize a hands-free mobile
electronic device while operating a motor vehicle."; and
(3) "It is
illegal in some counties for a pedestrian to cross a street or highway while
viewing a mobile electronic device."
(b) The office of consumer protection shall make
available on its public website an electronic version of the written notice
required by subsection (a) for retailers to print; provided that a retailer may
instead use any sign or notice that meets the requirements of subsection (a).
(c) The department of commerce and consumer
affairs may adopt rules pursuant to chapter 91 to carry out the purposes of
this section, including rules relating to the size and placement of the written
notice required by subsection (a).
(d) For purposes of this section:
"Mobile electronic
device" has the same meaning as defined in section 291C-137.
"Retailer" means any person or entity who sells or offers to sell mobile electronic devices to the public."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
