A BILL FOR AN ACT

relating to CAPITAL improvements for the wahiawa wastewater treatment plant.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that recycled water is a quality source for irrigating agricultural lands. According to the department of health guidelines for the treatment and use of recycled water, R-1 water can be used on any form of irrigation for food crops, including all edible root crops, where the recycled water comes into contact with the edible portion of the crop.

The legislature further finds that the State is working with the city and county of Honolulu to divert the R-1 water from the Wahiawa wastewater treatment plant so local farmers have diverse sources of irrigation. The treatment plant produces one million six hundred thousand gallons per day of R-1 quality recycled water, and the outfall continues to enter Lake Wilson. In order to divert the water, the city and county of Honolulu requires additional capacity to store non-spec water on the site of the treatment plant before it can divert R-1 water. In the public interest, health, safety, and general welfare of the State, the legislature finds that the State must invest to improve the storage capacity at the Wahiawa wastewater treatment plant to ensure that the local agriculture industry has access to water and the city and county of Honolulu can manage the treatment plant. The State receives a long-term benefit by investing into the facility as it will receive R-1 water at no cost up to the amount of the investment, and, by receiving R-1 water at no cost, local farmers will also have access to cheaper forms of irrigation.

The purpose of this Act is to appropriate funds for a capital improvement project for the Wahiawa wastewater treatment plant.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $9,750,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2019-2020 for the purpose of a capital improvement project at the Wahiawa wastewater treatment plant, as follows:

Site improvements and infrastructure development

Plans $1,000

Design $1,000

Construction $9,747,000

Equipment $1,000

Total funding $9,750,000

SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2022, shall lapse as of that date.

SECTION 4. The sums appropriated for the respective capital projects set forth in section 2 shall be expended by the city and county of Honolulu for the purposes of this Act.

SECTION 5. This Act shall take effect on July 1, 2019.
