HOUSE RESOLUTION
requesting the counties to develop procedures to accept donations of certain lands.
WHEREAS, private lands in the State have sustained damage due to flooding, hurricanes, volcanic eruptions, and other natural disasters, and lands along the coastlines will inevitably be lost to the effects of climate change; and
WHEREAS, lava disasters in 1990 and 2018 have destroyed towns and villages on the Big Island while Waikiki and other coastal areas will face infrastructure challenges against an encroaching sea; and
WHEREAS, the State and counties need to develop innovative disaster loss mitigation strategies in order to limit the future costs to the State and counties due to disasters that befall landowners who have built their homes in flood areas and lava zones; and
WHEREAS, the Legislature believes that the counties are important partners in developing and implementing disaster loss mitigation strategies for the benefit of the public; and
WHEREAS, the counties and owners of land likely to be damaged by disasters or flooding would benefit from procedures for the acceptance of private land as donations for which the donor would receive a nonrefundable charitable income tax deduction; now, therefore,
BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2020, that the counties are requested to develop procedures to accept donations of private lands that are damaged or likely to sustain damage due to natural disasters or climate change; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Mayors of each county or city and county in the State.
