A BILL FOR AN ACT
relating to the statewide traffic code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 291C-13, Hawaii Revised Statutes, is amended to read as follows:
"§291C-13 Accidents involving damage to vehicle or
property. (a) The driver of any vehicle involved in an
accident resulting only in damage to a vehicle or other property that is driven
or attended by any person shall immediately stop [such] the
vehicle at the scene of the accident or as close thereto as possible, but shall
forthwith return to, and in every event shall remain at, the scene of the
accident until the driver has fulfilled the requirements of section 291C-14. Every [such] applicable stop
shall be made without obstructing traffic more than is necessary[.]; subject
to subsection (b).
(b) If an accident as described in subsection (a)
occurs on a roadway nearest a berm or shoulder, the driver shall stop on the berm
or shoulder, return to the scene of the accident, and, if possible and safe to do
so, assist other drivers involved in the accident in moving their vehicle or
other property to the berm or shoulder as necessary; provided that this subsection
shall not apply if at least one roadway separates the nearest berm or shoulder
from the roadway that is the scene of the accident.
(c) For any violation under this section, a surcharge of up to $100 may be imposed, in addition to other penalties, which shall be deposited into the trauma system special fund."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
