A BILL FOR AN ACT
RELATING TO SERVICE IN NON-CRIMINAL PROCEEDINGS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to convene a task force in the judiciary to review amending the procedure for the giving of notice or service of legal process in civil and administrative proceedings by allowing documents to be served upon parties by electronic mail.
SECTION 2. (a) There is established within the judiciary, for administrative purposes, a temporary task force that shall discuss, review, and seek input on amending the procedure for the giving of notice or service of legal process in civil proceedings in the district, circuit, and family courts and in administrative proceedings by allowing documents to be served upon parties by electronic mail.
(b) The task force shall consist of:
(1) One representative from the judiciary, who shall serve as chair of the task force;
(2) One representative chosen by the president of the senate;
(3) One representative chosen by the speaker of the house of representatives;
(4) One representative from the department of the attorney general;
(5) One representative from the department of the prosecuting attorney for the city and county of Honolulu; and
(6) One representative from the office of the public defender.
(c) The chair of the task force may invite other interested parties to join the task force.
(e) The task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2020.
(f)
The task force shall cease to exist on June 30, 2020.
SECTION 3. This Act shall take effect on January 28, 2081.
