A BILL FOR AN ACT
relating to autism spectrum disorder.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§346-
Home and community-based services
waiver program for children with autism spectrum disorder. (a)
The med-QUEST division of the department shall seek a state plan waiver
from the Secretary of Health and Human Services pursuant to 42 U.S.C. section
1396n to establish a home and community-based services waiver program for
children diagnosed with an autism spectrum disorder.
(b) Eligibility for participation in the program
shall be limited to an individual who:
(1) Is from two
through twenty-one years old;
(2) Has been diagnosed
with an autism spectrum disorder;
(3) Requires
services from an intermediate care facility for the intellectually disabled;
(4) Has an
individual family service plan or individualized education program with fifteen
hours of special education and related issues;
(5) Is able to be
served in the home and community with services provided through this program;
(6) Has a monthly income
that does not exceed three hundred per cent of benefits under the Supplemental
Security Income program, and whose countable assets do not exceed the
applicable limits under the Supplemental Security Income program; and
(7) Meets any additional medical or financial criteria established by the department by rule pursuant to chapter 91."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
