A BILL FOR AN ACT
RELATING TO HEALTH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§321- Opioid
treatment programs; regulation; enforcement. (a) The department of health shall establish and
enforce rules for the regulation of opioid treatment programs within the State.
(b) The rules established by the department shall
comply with applicable state and federal laws and, at a minimum, shall establish:
(1) Criteria for
the certification of an opioid treatment program;
(2) Procedures
to identify individuals who divert opioid treatment medications from their intended
treatment or prescribed use and to terminate the treatment of those individuals;
(3) Requirements
for the random drug testing of patients in an opioid treatment program, and
specify the drugs for which the tests are being administered to detect;
(4) Regulatory
fees for an opioid treatment program; and
(5) Penalties for violations."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for the regulation of opioid treatment programs.
The sums appropriated shall be expended by the department of health for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2019.
