A BILL FOR AN ACT

relating to tuition waivers.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§304A- Tuition waivers; spouses and children of deceased veterans who are eligible for gold star status. (a) The university of Hawaii and the community colleges of the State may waive tuition in full or in part for any qualified student who is a spouse or child:

(1) Of a deceased member of the armed forces; and

(2) Who shall provide specific proof that the applicant would qualify for a gold star lapel button pursuant to the criteria established by title 10 United States Code section 1126; provided that upon remarriage, a surviving spouse shall no longer be eligible for the tuition waiver under this section.

(b) For purposes of this section:

"Member of the armed forces" means a Hawaii domiciliary who was an active or reserve member of the United States military or naval forces, or a national guard member called to active duty, who served in the active federal service under title 10 or title 32 of the United States Code, and is deceased pursuant to title 10 United States Code section 1126(a).

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
