A BILL FOR AN ACT
RELATING TO PRIVATE ROADS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Private streets; maintenance and conformance to county standards. Any provision of law to the contrary notwithstanding, including section 46-16, any person who charges any fee or consideration for the use of any portion of a private street, highway, or thoroughfare that has been used by the general public for a period of not less than six months shall be responsible for the costs to maintain that private street, highway, or thoroughfare to conform to the construction and maintenance standards established for county streets, highways, or thoroughfares."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
