A BILL FOR AN ACT
relating to hospice.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that some patients are admitted
to hospice care having a limited amount of money designated for their care. Sometimes, this money is depleted before all hospice
services can be provided, and the patient's guardian is not available to consent
to additional funding or to make further decisions.
The purpose of this Act is to:
(1) Restrict the types of facilities that may provide hospice care; and
(2) Establish that a patient's guardian has the legal responsibility to advocate for their patient until the end of the patient's life.
SECTION 2. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§321- Hospice home providers; guardian responsibilities.
(a) Hospice care shall only be provided
by a licensed hospice care facility, care home, or foster home.
(b) A guardian
of a person in a hospice home shall have the legal responsibility to advocate for
the person until the end of the person's life."
SECTION 3. This Act does not affect rights and duties that
matured, penalties that were incurred, and proceedings that were begun before
its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
