A BILL FOR AN ACT
relating to education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI, subpart A, to be appropriately designated and to read as follows:
"§302A- School-level subaccounts for minor repair and
maintenance or minor energy efficiency measures. (a) Funds in each subaccount established pursuant to
section 302A-1504.5(b) shall be expended at the direction of the respective school's
principal for minor repairs and maintenance or minor energy efficiency measures
of school facilities that do not require a building permit or compliance with chapter
343.
(b) At least every five years, the auditor shall
conduct a financial audit of all contracts or agreements awarded by schools from funds in the subaccounts established
pursuant to section 302A-1504.5(b) to determine if the schools and their contractors
are in compliance with all relevant programmatic and financial
requirements. The first audit shall be
conducted within one year of July 1, 2024."
SECTION 2. Section 302A-1504.5, Hawaii Revised Statutes, is amended to read as follows:
"§302A-1504.5 School-level minor repairs and maintenance special fund[[];[]]
reporting of carry over funds. (a) There
is established within the state treasury a special fund to be known as the
school-level minor repairs and maintenance special fund, into which shall be
deposited all moneys collected pursuant to section 235-102.5(b), and any other
moneys received by the department in the form of grants and donations for
school-level improvements and minor repairs and maintenance. The special fund shall be administered by the
department and used to fund school-level minor repairs and maintenance. The department shall transfer moneys
collected pursuant to section 235-102.5(b), and may transfer any other moneys
received in the form of grants and donations for school-level improvements and
minor repairs and maintenance to the Hawaii 3R's school improvement fund
established pursuant to section 302A-1502.4.
(b) The department shall establish one subaccount within the special fund for each public school and annually allocate available moneys from the special fund to the subaccounts in equal amounts; provided that the annual allocation to each subaccount shall not exceed $75,000. Notwithstanding any other law to the contrary, funds allocated to each subaccount that are unencumbered at the close of each fiscal year shall lapse to the credit of the special fund's general balance on that date.
[(b)] (c) The department shall submit to the director of
finance a report that shall be prepared in the form prescribed by the director
of finance and shall identify the total amount of funds in the school-level
minor repairs and maintenance special fund and each subaccount that will
carry over to the next fiscal year. The
department shall submit the report to the director of finance within ninety
days of the close of each fiscal year and a copy of the report to the
legislature no later than twenty days prior to the convening of each regular
session."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2020.
