A BILL FOR AN ACT

 

 

relating to the department of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that county permitting and fee requirements may unduly slow the efforts of the department of education in developing in a timely fashion much-needed public school infrastructure to meet the needs of rapidly growing communities in the State.

     The purpose of this Act is to exempt new public school construction from county permits and fees for public works infrastructure.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to subpart A of part VI to be appropriately designated and to read as follows:

     "§302A-     Exemption from county permit requirements.  Beginning on July 1, 2020, no capital improvement project for the construction of a new public school shall be subject to any public works infrastructure requirement relating to fees or permits that are established by any county; provided that the department shall comply with the building, electrical, plumbing, and fire codes in existence at the time that the director of finance initially allots funds for the capital improvement project."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2020.
