A BILL FOR AN ACT

 

 

RELATING TO HERBICIDES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that to avoid exposing children to harmful chemicals many parks and public areas where children play have prohibited the use of certain herbicides.  Studies have shown that heavy or chronic exposure to these herbicides, including those containing glyphosate, can cause cancer, and developing children are particularly sensitive to the harmful effects.

     The purpose of this Act is to:

     (1)  Require the department of education to maintain a list of herbicides approved for procurement; and

     (2)  Prohibit certain herbicides, including those containing glyphosate, from being used on school premises beginning July 1, 2022.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-     Herbicides; procurement and use.  (a)  The department shall maintain a list of herbicides approved for procurement; provided that no product on the list shall contain glyphosate.

     (b)  No herbicide shall be used on a school campus without the approval of the head of the auxiliary services branch.

     (c)  For purposes of this section, "glyphosate" refers to the chemical N-(phosphonomethyl)glycine under the International Union of Pure and Applied Chemistry chemical nomenclature; that has a chemical abstract service registry number 1071-83-6; and that is intended to act as a herbicide by inhibiting the plant enzyme 5-enolpyruvylshikimate-3-phosphate synthase."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2022.
