A BILL FOR AN ACT
relating to balloons.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 339, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"Part . RELEASE OF BALLOONS
§339- Prohibited acts. No person shall release, outdoors,
balloons made of electrically conductive material and filled with a gas lighter
than air, as part of any public or civic event, promotional activity, or
product advertisement.
§339- Penalties. (a) Any person who violates this part shall be subject to a fine of $250.
(b) Any person who violates this part who has been previously convicted at least twice of violating this part shall be guilty of a misdemeanor.
(c) This part shall not apply to manned hot air balloons or to balloons used in governmental or scientific research projects.
§339- Rules. The department shall adopt rules pursuant to chapter 91 necessary to implement this part."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. This Act shall take effect upon its approval.
