A BILL FOR AN ACT
relating to health.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to subpart C of part IV to be appropriately designated and to read as follows:
"§302A- Confiscation
of electronic cigarettes and electronic cigarette products. (a)
A teacher or educator at a public school shall confiscate an electronic
cigarette or electronic cigarette product that is found in the possession of a
student who is under the age of twenty-one.
(b)
Each public school shall coordinate with the applicable county police department
for the proper disposal of electronic cigarettes or electronic cigarette products
confiscated pursuant to subsection (a).
(c)
No teacher or educator, nor the public school that employs the teacher
or educator, who acts or fails to act in accordance with this section shall be
liable in any court of law for acting or failing to act in accordance with this
section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
