A BILL FOR AN ACT
RELATING TO THE RISK ASSESSMENT WORKING GROUP.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the risk
assessment working group, which bears the responsibility of providing
consultation to the board of land of natural resources regarding the design and
placement of warning signs, devices, or systems on improved public lands, has never
held a meeting. As the working group is responsible
for a task that would help the State minimize the potential for liability exposure,
it is crucial that the working group meet on a regular basis.
The purpose of this Act is to require the risk assessment working group to meet no less than twice each fiscal year.
SECTION 2. Section 171-8.6, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) There is established a risk assessment
working group that shall be administratively attached to the department. The risk assessment working group shall provide
consultation to the board regarding the design and placement of warning signs,
devices, or systems on improved public lands as defined in section 663-51,
including any comprehensive plan submitted by the State, a county, or managing
entity, to the board for approval. The
risk assessment working group shall meet no less than twice each fiscal year
and shall consist of the following members, who shall serve without
compensation:
(1) The chairperson of the
board, or designee;
(2) The mayor of each
county, or designee;
(3) The administrators of
the department's division of forestry and wildlife and the division of state
parks, or their designees;
(4) The attorney general,
or designee; and
(5) A person appointed by
the chairperson of the board knowledgeable in warning sign design."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2020.
