A BILL FOR AN ACT
RELATING TO TOBACCO.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 302A-102, Hawaii Revised Statutes, is amended to read as follows:
"§302A-102 Smoking prohibited. (a) All public schools within the State, from kindergarten through grade twelve, shall prohibit the use of tobacco, including the smoking of tobacco and use of chewing tobacco, at public schools or at public school functions.
(b) Any person under the age of twenty-one who
uses tobacco at a public school or public school function shall be required to
attend a tobacco education course.
(c) As used in this section:
"Chewing tobacco" means
any tobacco product exclusively intended for the purpose of chewing.
"Tobacco education course" means a course approved by the department of health that integrates a best practices curriculum to promote tobacco cessation."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2020-2021 for tobacco education courses required pursuant to this Act.
The sum appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2050.
