A BILL FOR AN ACT
relating to pesticides.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that unlike the majority of Hawaii's farmers, large-scale, outdoor commercial agricultural operations regularly apply high volumes of restricted use pesticides into the environment. The United States Environmental Protection Agency classifies pesticides as restricted use pesticides if they are determined to cause "unreasonable adverse effects on the environment" when used "without additional regulatory restrictions".
The legislature further finds that misuse of pesticides by large-scale commercial agricultural operations has been occurring, endangering the health of farm workers, nearby residents, and local environment. Pesticides may volatilize, changing from a solid or liquid state into a vapor state, and remain present in the lower atmosphere for days, weeks, or months after the application. Accordingly, the legislature finds that the drift from the application or misuse of pesticides may have lingering effects on human health and the environment long after the initial exposure. The legislature notes that the direct, indirect, and cumulative impacts on the environment and public health relating to the long-term, intensive commercial use of pesticides have not been properly or independently evaluated. The May 2016 study by the independent Joint Fact Finding Study Group, entitled Pesticide Use by Large Agribusinesses on Kauai, confirms that the State lacks sufficient data on pesticide use and human environmental exposure. Specifically, the study group recommended that the State establish a state comprehensive buffer zone policy.
The legislature further finds that children, elderly individuals, and other residents who may be sensitive to pesticide exposure have no choice but to live, work, and commute daily near areas where restricted use pesticides are being sprayed. Children can be exposed to pesticides applied on or drifting over school grounds or pesticide residues. Cancer, decreased cognitive functions, behavioral problems, and other long-term health effects have been linked to individuals who have life-long exposure to pesticides. With the enactment of Act 45, Session Laws of Hawaii 2018, the State took the initial steps to address the harms of restricted use pesticides, including establishing buffer zones around schools during specified hours.
The purpose of this Act is to protect the State's environment and residents by expanding the existing buffer zone restrictions around schools.
SECTION 2. Section 149A-25, Hawaii Revised Statutes, is amended by amending the definition of "normal school hours" to read as follows:
""Normal
school hours" means Monday through Friday from [7:00] 6:00
a.m. until [4:00] 6:00 p.m., excluding days when
classes are not in session[.] and the
facilities of the school are not in use for an entire day."
SECTION 3. Section 149A-28, Hawaii Revised Statutes, is amended to read as follows:
"[[]§149A-28[]] Buffer zones[.]; schools. [Beginning
January 1, 2019, no] No person shall apply a restricted use
pesticide on or within [one hundred feet of] one-quarter mile from
a school property during normal school hours; provided that this section shall
not apply to whole structure fumigation; provided further that if this section
is determined to conflict with any pesticide application information listed on
the pesticide label, the more restrictive provision shall apply."
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 5. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 6. This Act shall take effect on January 1, 2021.
