A BILL FOR AN ACT
RELATING TO GRID-INTERACTIVE WATER HEATER SYSTEMS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§269- Grid-interactive water heater system
required for new multi-unit dwelling construction; standards. (a) On or after January
1, 2022, no building permit shall be issued for a new multi-unit dwelling that
does not include a grid-interactive water heater system that meets the
standards established pursuant to subsection (b),
unless a renewable
energy technology system, as defined in section 235‑12.5, is substituted
for use as the primary energy source for heating water.
(b)
As soon as reasonably practicable and no later than July 1, 2021, the
commission shall adopt or establish by rule, tariff, order, or program, standards
for grid-interactive water heater systems to promote the objectives of section 269-124.
(c)
Nothing in this section shall preclude any county from establishing
procedures and standards required to implement this section.
(d)
Nothing in this section shall preclude participation in any utility
demand-side management program or public benefits fee program under part VII of
chapter 269.
(e) For purposes of this section, "grid-interactive
water heater system" means an electric resistance water heater fitted with
grid-integrated controls that are capable of participating in an electric
utility load control or demand response program."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2050.

Commencing January 1, 2022, prohibits the issuance of building permits for new multi-unit dwellings that do not include grid-interactive water heater systems. Requires the PUC to establish standards for the systems. Effective 7/1/2050. (HD1)
