A BILL FOR AN ACT

 

 

relating to the ignition interlock program.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291E-     Ignition interlock device; negative reports.  (a)  Notwithstanding any provision of this chapter to the contrary, the requirement to have an ignition interlock device installed in a vehicle shall continue until the person submits to the director and the director of transportation a certificate from the ignition interlock vendor stating that the device did not record a negative report during the last ninety consecutive days of the required installation period.  The director shall release the person from the ignition interlock device requirement as soon as practicable after the director receives the certificate.

     (b)  If a negative report is recorded during the last ninety consecutive days, the person shall continue to use an ignition interlock device until the person submits to the director and the director of transportation a certificate from the ignition interlock vendor stating that the device has not recorded a negative report for ninety consecutive days, beginning on the date of the most recent negative report.

     (c)  The requirements of subsection (b) shall be in addition to any penalty required for a violation of section 291E-66.

     (d)  As used in this section, "negative report" includes a report of tampering with an ignition interlock device, unauthorized removal of an ignition interlock device, lockout, or a test violation recorded by an ignition interlock device."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
