Status

RELATING TO HAWAIIAN AS AN OFFICIAL LANGUAGE OF THE STATE OF HAWAI‘I.

Inserts article thirteen of the United Nations Declaration on the Rights of Indigenous Peoples into the Hawaii Revised Statutes.  Requires that Hawaiian be used for public acts and transactions.  Directs the office of language access to provide services to Hawaiian language speakers.  Requires the Hawaiian version of a law be held binding if the law in question was originally drafted in Hawaiian and then translated into English.  Requires that ‘okina and kahako be used, when appropriate, in documents prepared by or for state or county agencies or officials, with certain exceptions.  Amends existing law so that any rule, order, policy, or other act, official or otherwise, that prohibits or discourages the use of ‘okina and kahako, except those specifically designed for the benefit of native speakers of Hawaiian, shall be void.  (SD2)

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Requires the Department of Hawaiian Home Lands to digitize its applicant, beneficiary, and lessee records.  Effective 7/1/2050.  (SD2)

RELATING TO THE HAWAIIAN LANGUAGE.

Requires any Hawaiian words or names included in public acts and transactions to be accurate, appropriate, and authentic.  Requires all newly created, replaced, or reprinted letterheads, documents, symbols, and emblems of the State and other political subdivisions that include Hawaiian words or names to include accurate, appropriate, and authentic Hawaiian words, names, spelling, and punctuation.  Establishes references for accurate, appropriate, and authentic Hawaiian names and words, including proper Hawaiian spelling and punctuation.  Clarifies that the full text of bills and other official documents are not required to be written in Hawaiian and that misspelled or incorrectly punctuated Hawaiian words and names shall not invalidate the documents or render them unenforceable and no cause of action shall arise accordingly.  (SD2)

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.

Increases the maximum amount of public funds available to each candidate running for the board of trustees of the office of Hawaiian affairs to fifteen per cent of the expenditure limit established for each election.  Increases the amount each board of trustees candidate must raise in order to qualify for public funds.  (SD1)

Clarifies requirements for land recordation of deregistered lands by the bureau of conveyances to include a plan of the parcels or parcels sought to be deregistered that includes a map and description prepared by a licensed professional surveyor.  (SD1)

MAKING AN EMERGENCY APPROPRIATION TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Makes an emergency appropriation to provide funds for the Hawaii Community Development Authority for its payroll, fringe benefits, and administrative costs.  Effective 7/1/2050.  (SB1188 SD1)

RELATING TO LAND DEVELOPMENT.

Requires the Department of Land and Natural Resources to allocate ten percent of revenues collected from commercial properties within the Banyan Drive redevelopment area to the Banyan Drive Hawaii Redevelopment Agency.  Appropriates funds to the Agency for conducting environmental impact and other studies that are necessary to complete the Agency's redevelopment plan for the Banyan Drive redevelopment area.  Requires matching funds from the County of Hawaii.  Effective 12/31/2050.  (SD2)

Status

RELATING TO LAY NETS.

Prohibits the use of lay nets to take aquatic life, except under a permit obtained by the department of land and natural resources.  Establishes the use of lay nets to take aquatic life as a misdemeanor offense.  Takes effect 12/31/2050.  (SD2)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·    Testifier's name with position/title and organization;

·    The Committee(s) to which the comments are directed;

·    The date and time of the hearing; and

·    Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

 

Submit testimony in ONE of the following ways:

PAPER: 10 copies (including an original) to Room 322 in the State Capitol;

FAX:     For testimony less than 5 pages in length, transmit to 808-586-8484 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or

WEB:    For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

If during the course of the hearing it appears there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three-minutes.  This three-minute policy will be enforced to ensure fairness and adequate consideration to all bills.
