MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF PUBLIC SAFETY. Makes an emergency appropriation to provide funds for the Department of Public Safety to pay for the temporary housing of 248 inmates at a non-state facility for the remaining six months of fiscal year 2019, during work on capital improvements to the Halawa Correctional Facility, under DAGS Job No. Job No. 12-27-5644 – security electronics and hardware repairs and improvements.

RELATING TO CRIMINAL PRETRIAL REFORM. Implements recommendations of the Criminal Pretrial Task Force convened pursuant to House Concurrent Resolution No. 134, House Draft 1, Regular Session of 2017.

RELATING TO PRETRIAL RELEASE. Requires courts to order any person charged with a criminal offense to be released on personal recognizance or on the execution of an unsecured bond, unless the person is unlikely to appear for trial. Requires the Judiciary to establish statewide court appearance reminder system. Establishes requirements for any pretrial risk assessment tool used by the Judiciary.

RELATING TO BAIL. Authorizes a defendant in custody to petition a court for unsecured bail.

RELATING TO MENTAL HEALTH EXAMINATIONS. Prohibits a court from committing a defendant to a suitable facility for a mental health examination for more than 30 days. Provides that if the required examinations cannot be conducted within 30 days, the court shall determine whether the defendant is eligible for supervised pretrial release or should be remanded to the custody of the Department of Public Safety. Provides that the court has continuing discretion to approve any agreement or stipulation of the parties to determine the fitness of a defendant to proceed with less than the number of required examinations.

RELATING TO PUBLIC REAL PROPERTY. Requires the Department of Public Safety to establish a temporary sheriff patrol program and the Governor's Coordinator on Homelessness to establish a program contracting private security for the enforcement of laws and rules prohibiting trespassing, camping, or being present after closing hours on certain state real property

RELATING TO PUBLIC SAFETY. Requires training, certification, and related records management and equipment for non-lethal use of force by deputy sheriffs appointed by the Department of Public Safety. Appropriates funds.

RELATING TO EMERGENCY ACCESS TO SHELTER. Prohibits public establishments from denying shelter to any person when an emergency alert advises the public to immediately seek shelter. Clarifies that remuneration or expectation of remuneration paid to owners of private property for goods or services other than emergency access to land, shelter, or subsistence, including services or incidental commodities to the emergency access, does not void the exemption from civil liability afforded to these owners except where owners increase the sale price of the service or incidental commodities.

RELATING TO EMERGENCY MANAGEMENT. To improve and enhance the effectiveness of the State Emergency Management Program through modifications and additions to the Hawaii Revised Statute Chapter 127A.

RELATING TO GUN VIOLENCE PREVENTION. Establishes the Hawaii Gun Violence Prevention Center in the AG's office to research strategies to prevent gun violence. Creates a special fund to support the Center. Appropriates funds.

RELATING TO PUBLIC SAFETY. Establishes a two-year pilot program on the island of Oahu to reduce recidivism through intervention, prevention, cultural support, and education initiatives. Appropriates funds.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
