RELATING TO PRIVATE PROPERTY.

Authorizes a property owner or agent to enter adjacent property under certain conditions to eradicate albizia trees before they become hazardous.  Provides defense to criminal prosecution.

RELATING TO TRAILS.

Requires government entities that engage in search and rescue operations to seek reimbursement when the rescued person required search and rescue efforts because that person acted in disregard of that person's safety, including intentionally disregarding a warning or notice.  Increases the penalty for unlawfully entering or remaining on a trail that has been closed to the public.

RELATING TO PUBLIC ACCESS.

Provides that where public access is required as a condition of a subdivision, either the county must accept dedication of and maintain the access or identify an entity to own and maintain the access.  Authorizes the county to require the subdivider to establish a stewardship fund for maintenance purposes.

RELATING TO WATER CONSERVATION.

Establishes a two-year water conservation financial assistance pilot program to provide financial assistance to county-owned public water systems.  Appropriates funds.  Repeals June 30, 2021.

MAKING AN APPROPRIATION FOR STATE LIFEGUARDS.

Appropriates unspecified funds for salaries and benefits for lifeguards for Kua Bay, Kekaha Kai state park, on the island of Hawai‘i, an area under the jurisdiction of DLNR.

      Status & Testimony

RELATING TO AGRICULTURE.

In any county where one-third or less of the county's land is classified in the state agricultural district, prohibits:  the creation of a condominium property regime on agricultural land twenty-five acres or greater; an existing condominium property regime on agricultural land greater than twenty-five acres from being amended to allow a single-family dwelling; and the subdivision of agricultural land twenty-five acres or greater for the purpose of creating a condominium property regime.

RELATING TO PUBLIC ACCESS TO THE SHORELINE IN SOUTH MAUI.

Requires the Department of Land and Natural Resources, in collaboration with the county councilmember representing the south Maui residency area, Kihei Community Association, and ‘Aha Moku O Kula Makai, to develop a master plan to expand public access to the shoreline in south Maui, particularly state-owned land.  Appropriates funds.
