RELATING TO FAMILY LEAVE. Extends the deadline for the Legislative Reference Bureau to submit the sunrise analysis required by Act 109, Session Laws of Hawaii 2018, from 9/1/2019, to 11/13/2019.

RELATING TO FAMILY LEAVE. Extends Hawaii family leave to include care for employees' grandchildren.

RELATING TO EMPLOYMENT PRACTICES. Prohibits written nondisclosure agreements involving sexual assault and sexual harassment as part of an employee's conditions of employment. Prohibits employers from retaliating against an employee for disclosing or discussing sexual harassment or sexual assault.

RELATING TO RETIREMENT SAVINGS. Requires the Legislative Reference Bureau to conduct a study on how to implement the Hawaii Retirement Savings Program and submit to the 2020 Legislature a report detailing its findings and proposals. Appropriates funds.

RELATING TO EQUAL PAY. Conforms statutory prohibitions against wage discrimination with other prohibitions on employment discrimination. Clarifies allowable justifications for compensation differentials and remedies for pay disparity. Requires employers to disclose wage ranges to employees and prospective employees.

RELATING TO EQUAL PAY. Prohibits the disclosure of an employee's wages by any person other than the employee.

RELATING TO FEDERAL WORKERS. Establishes a loan program to provide loans to eligible federal workers affected by the federal shutdown furlough. Provides an emergency appropriation to carry out the purposes of the loan program.

RELATING TO EMPLOYMENT. Clarifies that Hawaii's anti-discrimination law does not prohibit or prevent an employer, employment agency, or labor organization from refusing to hire or refer or from discharging an individual for reasons unrelated to unlawful discriminatory practices.

RELATING TO WORKERS' COMPENSATION. Requires persons performing an independent medical exam or permanent impairment rating exam for a workers' compensation work injury examine the employee within 30 calendar days upon receipt of notice. Provides that the employee be provided a copy of the exam within 30 calendar days. Makes the report invalid if the time requirements are not met.

RELATING TO WORKERS' COMPENSATION. Repeals the requirement that the examining physician or surgeon of an employee's medical examination approve of the recording of the medical examination relating to a work injury for workers' compensation purposes.

RELATING TO WORKERS' COMPENSATION. Requires a physician or surgeon who performs a medical exam on an employee for workers' compensation purposes to be licensed in the State, possess medical malpractice insurance, and owe the same duty and standard of care to the injured employee as owed to a traditional patient. Makes permanent an employee's right to record medical examinations.

RELATING TO WORKERS' COMPENSATION. Requires an employer to pay for all medical services related to an employee's compensable injury. Provides a process for an employer to dispute the payment of a medical bill.

RELATING TO WORKERS' COMPENSATION. Requires that workers registered with the department of health's medical cannabis program be reimbursed for the out of pocket cost of medical cannabis through the workers' compensation system in certain circumstances.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: 2 copies (including an original) to Room 324 in the State Capitol;
FAX: For testimony less than 5 pages in length, transmit to 808-586-8469 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
