RELATING TO THE HAWAII LABOR RELATIONS BOARD.

Authorizes the Hawaii labor relations board to accept paper and electronic filing of documents.

RELATING TO THE HAWAII LABOR RELATIONS BOARD.

Clarifies that the party seeking judicial review shall bear the cost of preparing a transcript, except as provided by law, in which case the Board shall bear the cost of preparing the transcript.

RELATING TO ADMINISTRATIVE PROCEDURES.

Allows the Hawaii labor relations board to admit and consider hearsay evidence in unfair labor practices proceedings.

Requires the Hawaii Labor Relations Board to determine qualifications for grievance arbitrators and interest arbitrators.  Requires the Hawaii Labor Relations Board to review and determine the qualifications and criteria for potential arbitrators selected under certain circumstances to resolve collective bargaining impasses.

Adds reproductive health decisions and utilization of family leave to the list of categories that are protected against discriminatory employment practices.

Exempts non-elected chief executive officers or heads of the executive branch of county government from the civil service laws.

RELATING TO GENDER EQUITY.

Requires all places of public accommodation and state building construction constructed or substantially modified after 12/31/20 to provide baby diaper-changing accommodations that are equally accessible to men and women.

RELATING TO MINIMUM WAGE.

Authorizes the counties to establish a minimum wage that is a higher wage than the state minimum wage under Chapter 387, Hawaii Revised Statutes.

Increases minimum wage rates annually beginning January 1, 2020.  Provides a lower rate for employees who receive employer-sponsored health benefits under the Hawaii Prepaid Health Care Act.  Provides for inflation-adjusted annual increases beginning in 2026.

RELATING TO FAIR EMPLOYMENT PRACTICES.

Prohibits noncompete agreements for low wage workers whose earnings do not exceed the greater of the hourly rate equal to the minimum wage required by applicable federal or state law or $15 per hour.

RELATING TO MINIMUM WAGE.

Includes persons with disabilities under the minimum wage requirements.

RELATING TO DISABLED PERSONS.

Establishes employment first as a state policy with respect to disabled persons.  Requires state and county agencies to implement this policy in hiring and all programs and services administered or funded by the State or counties.  Applies employment first principles to Medicaid home- and community-based waiver programs.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

 

Submit testimony in ONE of the following ways:

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
