RELATING TO NOISE CONTROL. Enhances community noise control as regulated by county liquor commissions in counties with a population of seven hundred thousand or more.

Proposed HD1: Authorizes State Health Planning and Development Agency to mandate the submission of Medicare Advantage (Medicare Part C) administrative data and healthcare services claims.

RELATING TO MENTAL HEALTH. Restores the categories of "gravely disabled" and "obviously ill" to the criteria for involuntary hospitalization that were deleted by Act 221, SLH 2013. Increases the maximum period of emergency hospitalization from 48 hours to 72 hours.

RELATING TO THE BOARD OF PHARMACY. Allows the board of pharmacy to approve pilot and demonstration projects for innovative applications in the practice of pharmacy under certain circumstances.

RELATING TO PALLIATIVE CARE. Requires the Department of Health to establish a culturally competent Palliative Care pilot program to promote public education on palliative care and establish home- or community-based palliative care projects.

RELATING TO MENTAL HEALTH. Appropriates funds to the Department of Health for the establishment of a long-term care facility that admits and treats non-forensic mental health patients for in-patient or out-patient temporary case management and requires that homeless patients receive priority admission for treatment.

RELATING TO HEALTH. Beginning January 1, 2020, requires the State's medicaid managed care and fee-for service programs to provide coverage for home and community-based services for individuals diagnosed as having autism. Requires the Department of Human Services to seek a section 1115 waiver to amend the state Medicaid plan to include this coverage.

RELATING TO MEDICAL EDUCATION. Appropriates funds to the Department of Health to perform a study regarding a pilot program to pay for Hawaii residents to attend a college of medicine in the Philippines in exchange for a commitment to practice medicine in Hawaii after graduation.

RELATING TO HEALTH. Authorizes the Department of Education, at its own expense, to develop and coordinate mental health training to be offered annually to complex area superintendents, registered school nurses, and school health aides. Includes autism and fetal alcohol spectrum disorder training.

RELATING TO ELECTRONIC SMOKING PRODUCTS. Establishes the offense of unlawful shipment of e-liquid products. Includes e-liquid within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law. Increases the license fee for persons engaged as a wholesaler or dealer of cigarettes and tobacco products. Increases the retail tobacco permit fee for retailers engaged in the retail sale of cigarettes and tobacco products. Allocates a portion of funds collected excise taxes on tobacco products to health education and prevention programs about the risks and dangers of the use of electronic smoking devices for youth. Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices.

RELATING TO HEALTH. Prohibits the shipment of tobacco products, and the transport of tobacco products ordered or purchased through a remote sale, to anyone other than a licensee. Makes all provisions of the cigarette tax and tobacco tax law that relate to tobacco products applicable to e-liquid. Increases the license fee for wholesalers or dealers and the retail tobacco permit fee. Amends the taxes on cigarettes and tobacco products. Increases the excise tax for each cigarette or little cigar sold, used, or possessed by a wholesaler or dealer. Increases the excise tax on the wholesale price of each article or item of tobacco products, other than large cigars, sold by the wholesaler or dealer.

RELATING TO FLAVORED TOBACCO PRODUCTS. Bans the sale of flavored tobacco products. Effective 1/1/2020.

RELATING TO HEALTH. Requires the Insurance Commissioner to perform a study on capitated payment rates in Hawaii that compares the payment model in Hawaii with the payment models in other states.

RELATING TO PHARMACY BENEFIT MANAGERS. Establishes requirements for pharmacy benefit managers and maximum allowable cost, including the ability of pharmacies to receive comprehensive maximum allowable cost lists and bring complaints within the purview of the department of commerce and consumer affairs, rather than the department of health. Requires pharmacy benefit managers to disclose where an equivalent drug can be obtained at or below the maximum allowable cost when a maximum allowable cost is upheld on appeal and allow contracting pharmacies to reverse and rebill claims if the pharmacy benefit manager establishes a maximum allowable cost that is denied on appeal and pay the difference to the contracting pharmacies. Clarifies the available penalties for violations of maximum allowable cost requirements.

RELATING TO HEALTH. Requires that advanced practice registered nurses be included within certain rules adopted by the Department of Health.
