     Your Committee on Judiciary, to which was referred H.B. No. 762, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO SINGLE-USE PLASTIC STRAWS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to prohibit a full-service restaurant from providing a single-use plastic straw to a consumer unless requested by the consumer.

 

     The Council Member representing District 7 of the Hawaii County Council; Sierra Club of Hawaii; American Chemistry Council; Animal Rights Hawaii; Retail Merchants of Hawaii; Hawaii Food Industry Association; Hawaii Restaurant Association; Ocean Tourism Coalition; KYD, Inc. dba k. yamada distributors; Oahu County Committee on Legislative Priorities of the Democratic Party of Hawaii; Kihei Community Association; and a few individuals testified in support of this measure.  Two individuals testified in opposition to this measure.  The Department of Health and Office of Hawaiian Affairs provided comments.

 

     Your Committee has amended this measure by deleting language which required this measure to take precedence over and preempt ordinances and rules adopted by a county, department, or agency regulating single-use plastic straws.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 762, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 762, H.D. 2.
