Your Committee on Water, Land, & Hawaiian Affairs, to which was referred H.B. No. 458 entitled:
"A BILL FOR AN ACT RELATING TO SMALL BOAT HARBORS,"
begs leave to report as follows:
The purpose of this measure is to authorize the transfer of responsibility for operations, administration, management, and maintenance of Kihei Small Boat Harbor from the Board of Land and Natural Resources to the Kaho‘olawe Island Reserve Commission.
Your Committee received testimony in support of this measure from the Department of Land and Natural Resources and the Kaho‘olawe Island Reserve Commission. Your Committee received testimony in opposition to this measure from Lahaina Divers, Inc.; Activities & Attractions Association of Hawaii; and two individuals. Your Committee received comments on this measure from the Ocean Tourism Coalition.
Your Committee notes that the Kaho‘olawe Island Reserve Commission and the Division of Boating and Ocean Recreation of the Department of Land and Natural Resources are currently in discussion regarding transfer of management responsibilities as authorized by this measure. Your Committee encourages the parties to continue productive dialogue and cooperation on this matter.
Your Committee has amended this measure by:
(1) Specifying that the particular facility for which management jurisdiction is to be transferred is the Kihei Launch Ramp; and
(2) Changing its effective date to July 1, 2050 to encourage further discussion.
As affirmed by the record of votes of the members of your Committee on Water, Land, & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 458, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 458, H.D. 1, and be referred to your Committee on Transportation.
