     Your Committee on Judiciary, to which was referred H.B. No. 175, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO BAIL,"

 

begs leave to report as follows:

 

     The purpose of this measure is to authorize a defendant in custody to petition a court for unsecured bail.

 

     The Office of the Public Defender, Office of Hawaiian Affairs, Hawaii Disability Rights Center, Community Alliance on Prisons, Hawaii Health & Harm Reduction Center, LGBT Caucus of the Democratic Party of Hawaii, Retail Merchants of Hawaii, League of Women Voters, IMUAlliance, Mental Health America of Hawaii, Hawaii Innocence Project, Drug Policy Forum of Hawaii, Young Progressives Demanding Action, Oahu County Committee on Legislative Priorities of the Democratic Party of Hawaii, Ohana Hoopakele, We Are One, Inc., and numerous concerned individuals supported this measure.  The Judiciary provided comments.

 

     Your Committee has amended this measure by specifying that unsecured bail is not available for certain offenses.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 175, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Finance in the form attached hereto as H.B. No. 175, H.D. 2.
