A BILL FOR AN ACT
relating to insurance.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10E to be appropriately designated and to read as follows:
"§431:10E- Disclosure; natural disaster; perils. (a)
An insurer shall affix to or include in a homeowners insurance policy a
written statement regarding the natural disaster perils not covered by the named
insured's policy; provided that nothing in this section shall be construed to
prohibit the attachment to any such policy of an endorsement or endorsements
specifically assuming coverage for loss or damage by named peril to an insured's
real or personal property.
(b) In addition to the requirements under
subsection (a), an insurer shall orally disclose to the named insured the
natural disaster perils not covered by the policy.
(c) This section shall apply to all homeowners
insurance policies delivered or issued for delivery in this State on or after
July 1, 2019.
(d) For purposes of this section, "natural disaster perils" means a natural disaster event that causes damage to real or personal property, including but not limited to damage caused by floods, hurricanes, tidal waves, volcanic eruptions, or earth movement, such as earthquakes, shockwaves, sinkholes, landslides, and mudflows."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2019.
