A BILL FOR AN ACT
relating to air quality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342B- Air quality measurement; investigation. (a)
Upon receipt of a complaint of an actual or suspected source of air
pollution in noncompliance with this chapter or the rules adopted pursuant to
this chapter, the department shall file a report and promptly dispatch
personnel to the source or the immediate vicinity of the source of the emission
to conduct the necessary investigation and reasonable tests, including
measurement or analysis of the emission or ambient concentrations of air
pollutants, to determine compliance or non-compliance.
(b) If the investigation and testing find that
the emission is noncompliant, the director may enforce the provisions of this chapter
as provided by section 342B-42."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
