RELATING TO PROCUREMENT. Requires the State Procurement Policy Board to conduct annual compliance examinations of procurement contracts that are over $50,000 of at least 2 executive departments, divisions, or agencies. Requires the State Procurement Policy Board to also select any department, division, or agency for a compliance examination to ensure compliance with the State Procurement Code. Requires the State Procurement Office to report its findings to the legislature. Effective 1/1/2050. (SD1)

RELATING TO GOVERNMENT ACCOUNTABILITY. Requires the chair of the appropriate subject matter committee to hold either a public hearing or informational briefing for any report of a study or an audit enacted with a legislative appropriation or adopted by concurrent resolution and conducted by an executive department or agency, including the Hawaii Health Systems Corporation; the Legislative Reference Bureau; the Auditor; the Judiciary; or the Office of Hawaiian Affairs, within one year of receipt of the report or study, except if an extension is granted by the senate president or speaker of the house of representatives or if the requirement is waived by the senate president or speaker of the house of representatives. Requires the Legislative Reference Bureau to develop a spreadsheet informing members of the legislature on the status and content of all reports to be submitted to the legislature as required by law or requested by legislative concurrent resolution. Enables a social club granted tax exempt status pursuant to section 501(c)(7) of the Internal Revenue Code to sell wine from the social club's inventory to the club's members for off-premises consumption under the class 10 liquor license. Waives fees and other requirements for applicants for a class 10 liquor license. Specifies that the class 10 special liquor license includes the ability to auction off, at a live or silent auction, liquor in sealed or covered containers or services that provide liquor. (SD1)

Permits an insurer to send a privacy notice every five years, if the relationship between the insurer and a customer is renewed annually or less than annually and the insurer has not changed its policies and practices regarding disseminating customers' nonpublic personal financial information to nonaffiliated third parties. Requires an insurer to provide an additional privacy notice upon renewal of a relationship between an insurer and a customer that lasts longer than a year. RELATING TO BROADBAND SERVICE. Requires a provider of broadband internet access services to be transparent with network management practices, performance, and commercial terms of its broadband internet access services. Prohibits a provider of broadband internet access services from blocking lawful websites, impairing or degrading lawful internet traffic, engaging in paid prioritization, or unreasonably interfering with or disadvantaging users of broadband internet access services. RELATING TO THE ENVIRONMENT. Requires, for any proposed action involving construction for which an environmental impact statement has been accepted by an agency but for which construction has not commenced within ten years of acceptance of the statement, the developer of the construction project to exercise due diligence with respect to any changes in the community where the project is planned and requires developers to hold community discussion and feedback sessions to discuss relevant and new concerns regarding the project. Exempts department of agriculture capital improvement projects on state agricultural lands and irrigation water systems. Takes effect 7/1/2025. (SD2)

RELATING TO PRESCRIPTION DRUGS. Requires prescribers of certain controlled substances to consult the electronic prescription accountability system before issuing a prescription for the controlled substance. Provides exemptions for certain circumstances. Provides that a violation by a prescriber shall not be subject to criminal penalty provisions but that a violation may be grounds for professional discipline pursuant to section 453-8 or 457-12, Hawaii Revised Statutes. Makes various updates to the structure and operations of the Public Utilities Commission to increase efficiency and effectiveness, including: establishing guiding principles; establishing docket review and decision-making processes; permitting teleconference and videoconference abilities; specifying senior staff members who must file public financial disclosures; beginning 1/1/2019, increasing the number of commissioners to 5; updating the composition of the Commission; specifying training requirements; clarifying commissioners' ability to appoint and employ staff; clarifying the roles of the executive officer and chief counsel; permitting neighbor island members to receive per diem compensation and compensation for travel expenses; and requiring the Commission to report to the Legislature regarding certain staff duties. RELATING TO MOVIE THEATERS. Makes permanent the requirement for certain motion picture theater owners and operators to provide open movie captioning for at least two showings per week, one of which has a scheduled start time no earlier than 4:30 p.m. Repeals the requirement to provide an option of personal closed captioning screenings by means of lightweight eyewear. Makes unlawful the shipment of tobacco products, and transport of tobacco products ordered or purchased through a remote sale, to anyone other than a licensee. Includes e-liquid within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law, thereby making all provisions of the cigarette tax and tobacco tax law that relate to tobacco products applicable to e-liquid as well. Increases the license fee for wholesalers or dealers and the retail tobacco permit fee. Effective 7/1/2050. (SD2)

RELATING TO MEDICATION SYNCHRONIZATION. Allows the synchronization of plan participants' medications. Requires plans, policies, contracts, or agreements that are offered by health insurers, mutual benefit societies, and health maintenance organization and provide prescription drug benefits, to apply prorated daily cost-sharing rates for prescriptions dispensed by network pharmacies for less than a thirty-day supply. RELATING TO MEDICAL COVERAGE. In the event of a controverted workers' compensation claim, requires an injured employee's private health care plan to pay for or provide medical care, services, and supplies; provided that when the claim is accepted, the employer shall reimburse the private health care plan and injured employee. In the event of an accepted claim for leukemia, multiple myeloma, non-Hodgkin's lymphoma, or certain cancers by a firefighter with five or more years of service, requires an employer to be liable for 137 per cent of medical care, services, and supplies.

Provides that a person with no physical presence in the State shall be considered to be engaged in business in the State if, in the current or immediately preceding calendar year, the person has gross receipts attributable to transactions in the State totaling $100,000 or more. Clarifies that a person who sells or assists in the sale of tangible personal property and who provides customer service, processes payments, and controls fulfillment is the seller of the property for general excise tax and use tax purposes. Requires dental assistants with four or more years' experience to apply or register for the DANB's Certified Dental Assistant certification. Exempts dental assistants with more than ten years' experience from having to obtain a Certified Dental Assistant certification, but requires these dental assistants to hold a cardiopulmonary resuscitation certification and pass the DANB's Infection Control examination within two years. Establishes and appropriates funds for a farm to school grant pilot program within the Hawaii Department of Agriculture to provide grants to schools, early care and education centers, nonprofits, soil and water conservation districts, and food producers participating in the Hawaii farm to school program. Requires the Hawaii farm to school coordinator to submit a report to the legislature. Authorizes the Hawaii Housing Finance and Development Corporation (HHFDC), at the request of the Hawaii Community Development Authority (HCDA), to establish and operate transit-oriented development infrastructure improvement zone subaccounts within the dwelling unit revolving fund for the benefit of infrastructure improvement projects within a transit-oriented development infrastructure improvement zone. Requires HCDA to develop a transit-oriented development infrastructure improvement zone program to foster infrastructure development by strategically investing in public facilities. Requires the executive director of HHFDC in collaboration with the executive director of HCDA and Hawaii interagency council for transit-oriented development to conduct a study examining the current infrastructure of a transit-oriented development infrastructure improvement zone and the requirements necessary to upgrade the infrastructure to facilitate future transit-oriented development. Appropriates funds out of the dwelling unit revolving fund for the infrastructure study. RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Clarifies the interests that must be represented by members of the Hawaii Community Development Authority representing community development districts.
