MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF PUBLIC SAFETY. Makes an emergency appropriation to provide funds for the Department of Public Safety to reimburse the Department of Human Services for specialty out-of-facility care and to pay the increased costs for pharmacy services. Effective 7/1/2050.

RELATING TO PUBLIC SAFETY. Requires the Department of Public Safety to establish performance indicators. Requires annual reports of the established performance indicators, criminal offender treatment programs, and programs established pursuant to the Community Safety Act.

RELATING TO MOTOR VEHICLE WEIGHT TAX. Excludes the weight of disability access modifications from the determination of net weight for non-commercial vehicles for purposes of levying the state and county motor vehicle weight tax. Effective 7/1/2050.

RELATING TO MOTOR VEHICLE REGISTRATION. Classifies certain former military vehicles as special interest vehicles. Enables owners of former military vehicles to apply for registration with the Director of Finance of the county in which the former military vehicle resides. Makes conforming amendments.

RELATING TO LANGUAGE ACCESS. Appropriates moneys for the establishment of 2 full-time equivalent (2.0 FTE) permanent program specialist positions within the office of language access to assist state agencies and state-funded agencies in implementing the requirements of Hawaii's language access law.

RELATING TO PARKING FOR DISABLED PERSONS. Limits the exemption from parking fees to drivers with a disability who are unable to operate a parking meter or pay station because of the driver's disability and who display a distinguishing parking device, code, permit, or decal. Clarifies time limits applicable to the exemption.

RELATING TO INSURANCE. Authorizes the State to apply for and implement a waiver from certain provisions of the Patient Protection and Affordable Care Act of 2010, as amended.

RELATING TO INTELLECTUAL AND DEVELOPMENTAL DISABILITIES MEDICAID WAIVER ADMINISTRATIVE CLAIMING SPECIAL FUND. Creates the Intellectual and Developmental Disabilities Medicaid Waiver Administrative Claiming Special Fund into which federal moneys may be deposited from the Department of Health's participation in the waiver program. Appropriates funds to support individuals with intellectual and developmental disabilities.

RELATING TO APPROPRIATIONS TO ADDRESS HOMELESSNESS. Appropriates funds to the Department of Human Services for the Coordinated Statewide Homeless Initiative. Requires the Department to procure the services of a master contractor to manage subcontracts and expenditures for services provided through the initiative.

RELATING TO TELEHEALTH. Requires the Department of Health to conduct a telehealth pilot project and publish an evaluation report on the pilot project outcomes. Exempts the pilot project from the State Procurement Code for a period of twelve months. Clarifies that the period of performance of all procurements made during this temporary exemption does not exceed the term of the pilot project.

RELATING TO PHARMACY BENEFIT MANAGERS. Establishes requirements for pharmacy benefit managers and maximum allowable cost, including the ability of pharmacies to receive comprehensive maximum allowable cost lists and bring complaints within the purview of the Department of Commerce and Consumer Affairs, rather than the Department of Health. Requires pharmacy benefit managers to disclose where an equivalent drug can be obtained at or below the maximum allowable cost when a maximum allowable cost is upheld on appeal. Allows contracting pharmacies to reverse and rebill claims if the pharmacy benefit manager establishes a maximum allowable cost that is denied on appeal and is required to pay the difference to the contracting pharmacies. Preserves the prohibition of a contracting pharmacy from disclosing the maximum allowable cost list and related information to any third party.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
