Requires that revenue estimates provided by DOTAX to the legislature or to any executive or administrative office be accompanied by a description of the methodology used and assumptions made in providing the estimate.  Requires that the estimate and description be open to public disclosure.

RELATING TO WASTE MANAGEMENT.

Requires that all state and county agency contractors that dispose of liquid or solid waste to provide a receipt that the waste was received and disposed of at a licensed facility before full payment is made for those contractual services.  Allows for partial payment to be made without a receipt and prior to any dumping of waste.  Prohibits alteration or falsification of receipts.

RELATING TO SALARY OVERPAYMENTS.

Requires each department to deduct the department's total salary overpayment from the department's budget request for the following fiscal biennium.  Requires that employees who exhaust their sick leave be placed on a manual accounting system.  Removes the two-year statute of limitations on determination and notice to an employee of salary and wage overpayment.  Allows officers charged with collecting debt due to salary or wage overpayment to garnish the pension of former employees.  Takes effect 7/1/2050.  (SD1)

RELATING TO PROCUREMENT.

Requires past performance to be factored into future bid selection of a contractor.  Establishes factors to be included in any evaluation, consideration, or review of past performance required pursuant to part II of chapter 103D, Hawaii Revised Statutes, and ratings standards for those factors.  Requires past performance to be considered in sole source procurement.  Requires that upon completion of a procurement contract, the department that issued the request for proposal shall evaluate the work and performance of the respective contractors and maintain the evaluations in the department's files.  Appropriates funds.  (SD1)

RELATING TO PROCUREMENT.

Requires the state procurement policy board to annually review and examine procurement contracts of at least two executive department, division, or agency contracts that are over $50,000.  Requires the state procurement policy board to randomly perform compliance examinations of government purchasing agencies and examinations of agencies selected based on a pattern of agency noncompliance.

RELATING TO GOVERNMENT ACCOUNTABILITY.

Requires any report of a study or an audit enacted with a legislative appropriation or adopted by concurrent resolution and conducted by an executive department or agency, including the Hawaii health systems corporation, and by the legislative reference bureau, auditor, judiciary, or Office of Hawaiian Affairs, to be submitted to the senate president, speaker of the house, chairs of the appropriate subject matter committee of each house, and the legislative reference bureau library.  Requires a public hearing or informational briefing within one year of receipt of report, except if extension granted to the hearing or briefing requirement by the senate president or speaker of the house of representatives or if the requirement is waived by the senate president or speaker of the house of representative. Exempts financial and other regularly occurring audits.  (SD1)

Requires the Legislative Reference Bureau to develop a spreadsheet informing members of the legislature on the status and content of all reports to be submitted to the legislature as required by law or requested by legislative resolution.  Requires the legislative reference bureau to inform the legislature of all annual and other reports required by law to be submitted to the legislature or requested by legislative resolution that were not timely submitted.  Requires reporting entities to submit a copy of all reports submitted to the legislature to the legislative reference bureau.  (SD1)

RELATING TO LAW ENFORCEMENT.

Establishes an enforcement division in the Department of the Attorney General.  Transfers to the Department of the Attorney General enforcement division the law enforcement activities of the Department of Land and Natural Resources, Division of Conservation and Resources Enforcement; the Department of Public Safety state law enforcement officers and the narcotics enforcement division; and the Department of Transportation harbors division.  Repeals the sunset of Act 116, SLH 2013, as amended by section 4 of Act 101, SLH 2015.  Effective 7/1/2050.  (SD1)

Requires all government procurement officers to attend a training and development program prior to participating in or authorizing any procurement.  Requires all government procurement officers to complete review training every three years.  Requires all procurement officers, department heads, and their deputies, except for the administrator, to attend mandatory procurement training within ninety days of appointment.  Appropriates funds.

Requires any government body that enters into a contract that is exempt from the state procurement code pursuant to section 103D-102(b), Hawaii Revised Statutes, such as a contract for procurement of services of attorneys employed or retained to advise, represent, or provide any other legal service to the State or any of its agencies, on matters arising under the laws of another state or foreign country, or in an action brought in another state, federal, or foreign jurisdiction, when substantially all legal services are expected to be performed outside this State, and when procurement by competitive means would be impractical or not advantageous to the State, to report that contract to the State Procurement Office and Legislature.

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Establishes the east Kapolei community development district under the Hawaii community development authority.  Repeals the laws relating to the Kakaako community development district and replaces members representing the Kakaako community development district of the Hawaii community development authority with members representing the east Kapolei community development district.  Makes conforming amendments.  Requires the Hawaii community development authority to develop a transitional master plan for the Kakaako community development district to transition into dissolution and be repealed.  Takes effect on 07/01/2050.  (SD1)

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Clarifies the interests that must be represented by members of the HCDA representing community development districts.  Requires the senate president and the speaker of the house of representatives to nominate representatives of the several community development districts to the HCDA, and requires those representatives to be nominated only as a resident representative or a small business owner or nonprofit organization representative, but not both.

RELATING TO HOMELESSNESS.

Expands eligibility and credit amount of the low income-household renters' income tax credit.  Appropriates funds for the continued administration of the family assessment center for homeless families and for a housing homeless children rental assistance pilot program.  Exempts adoption of interim rules and procurement of services by federally-certified financial counselors from chapters 91 and 103D, Hawaii Revised Statutes, respectively.  (SD1)

PROPOSING AN AMENDMENT TO ARTICLE X, SECTION 6, OF THE HAWAII STATE CONSTITUTION, TO MODIFY THE APPOINTMENT PROCESS FOR THE BOARD OF REGENTS OF THE UNIVERSITY OF HAWAII.

Proposes an amendment to article X, section 6, of the Hawaii State Constitution to modify the appointment process for the board of regents of the University of Hawaii.  Repeals reference to the candidate advisory council for the board of regents of the University of Hawaii.

RELATING TO THE UNIVERSITY OF HAWAII BOARD OF REGENTS.

Amends the composition and term limit of the board of regents of the University of Hawaii.  Reestablishes the governor's authority to nominate and, with the advice and consent of the senate, appoint the members of the board of regents of the University of Hawaii.  Requires the governor to fill a vacancy on the board of regents within ninety days.  Pursuant to a proposed constitutional amendment, abolishes the regents candidate advisory council for the board of regents of the University of Hawaii.  Requires the governor to nominate new members to the board of regents by January 29, 2019, and for those new members who are appointed to begin serving terms on March 1, 2019.  (SD1)

RELATING TO THE PACIFIC INTERNATIONAL SPACE CENTER FOR EXPLORATION SYSTEMS.

Amends section 201-76, Hawaii Revised Statutes, to expressly place the Pacific International Space Center for Exploration Systems within the Department of Business, Economic Development, and Tourism.  Deletes the executive director of the space center as a member of the board and adds the Chancellor of the University of Hawaii at Hilo.  Establishes a ceiling of $1,000,000 for the Pacific international space center for exploration systems special fund.  Repeals the office of aerospace development and transfers all rights, powers, functions, and duties to the Pacific international space center for exploration systems.  (SD1)
