RELATING TO ORDERS FOR TREATMENT OVER OBJECTION. Authorizes psychiatric and medical treatment by administrative order despite a patient's objection for pretrial detainees or committed persons in the custody of the Department of Public Safety. Establishes criteria for issuing court or administrative order and the process to determine whether administrative order should be issued for psychiatric or medical treatment over the patient's objection. Effective 7/1/2018.

RELATING TO THE RELEASE OF MISDEMEANANTS. Defines the circumstances for the Director of Public Safety or a designee of the director to release pretrial and sentenced misdemeanants at community correctional centers.

RELATING TO PAROLE. Clarifies circumstances under which the Hawaii Paroling Authority may grant early discharges. Provides the paroling authority with discretion when considering pardons for paroled prisoners and clarifies early discharge consideration of paroled prisoners is an administrative action, not an in-person hearing before the authority.

MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF PUBLIC SAFETY. Makes an emergency appropriation to provide funds for the Department of Public Safety to pay for the temporary housing of 248 inmates at a non-state facility for an additional six months, during work on capital improvements to the Halawa Correctional Facility, under DAGS Job No. Job No. 12-27-5644 – security electronics and hardware repairs and improvements.

RELATING TO CORRECTIONS. Limits the Director of Public Safety's ability to transfer convicted felons to any federal correctional institution or a correctional institution in another state to only those felons incarcerated for violent crimes under HRS section 351-32. Requires that all felons incarcerated in an out-of-state correctional institution or an out-of-state federal correctional institution for a crime that is not a violent crime under HRS section 351-32 be returned to Hawaii no later than July 1, 2020. Repeals the Governor's authority to negotiate or contract for expansion or construction of private correctional facilities.

RELATING TO PUBLIC SAFETY. Requires DPS to establish performance indicators. Requires quarterly reports of the established performance indicators, criminal offender treatment programs, and programs established pursuant to the community safety act.

RELATING TO PUBLIC SAFETY. Requires the Department of Public Safety to establish key performance indicators for inmate reentry system. Requires reports, using key performance indicators, to be provided to the legislature. Creates the annual corrections and program report as a consolidated report of other annual reports.

RELATING TO PRETRIAL RELEASE. Requires courts to order any person charged with a criminal offense to be released on personal recognizance or on the execution of an unsecured bond, unless the person is unlikely to appear for trial. Requires the Judiciary to establish statewide court appearance reminder system. Establishes requirements for any pretrial risk assessment tool used by the Judiciary.

RELATING TO CORRECTIONAL INSTITUTIONS. Establishes procedures for the use of administrative and disciplinary segregation in correctional institutions.

RELATING TO TAXATION. Provides an income tax credit for wages paid by a technology business owner to employees who were formerly in the custody of the department of public safety.
