RELATING TO PRETRIAL RELEASE. Requires courts to order any person charged with a criminal offense to be released on personal recognizance or on the execution of an unsecured bond, unless the person is unlikely to appear for trial. Requires the Judiciary to establish statewide court appearance reminder system. Establishes requirements for any pretrial risk assessment tool used by the Judiciary.

RELATING TO PRETRIAL RELEASE. Requires courts to order any person charged with a criminal offense to be released on personal recognizance pending trial, unless the person is a flight risk, unlikely to appear for trial, or a danger to others. Requires the Judiciary to establish and maintain a Pretrial Services Program to conduct pretrial risk assessments. Repeals state laws relating to bail.

RELATING TO PAROLE. Clarifies circumstances under which the Hawaii Paroling Authority may grant early discharges. Provides the paroling authority with discretion when considering pardons for paroled prisoners and clarifies early discharge consideration of paroled prisoners is an administrative action, not an in-person hearing before the authority.

RELATING TO THE RELEASE OF MISDEMEANANTS. Defines the circumstances for the Director of Public Safety or a designee of the director to release pretrial and sentenced misdemeanants at community correctional centers.

RELATING TO HAWAII CORRECTIONAL INDUSTRIES. Establishes a three-year Correctional Industries Former Inmate Employment Pilot Project within the Department of Public Safety to assist former inmates as they reenter society.

RELATING TO PUBLIC SAFETY. Requires the return of all out-of-state inmates by 12/31/20 if adequate bed space exists in Hawaii's prisons and correctional facilities. Provides that no more than 500 Hawaii inmates shall be detained in out-of-state prisons by 12/31/19. Requires the Department of Public Safety to plan, design, and construct sufficient facilities to house inmates in Hawaii and to pursue alternatives to incarceration for returning inmates. Authorizes the issuance of general obligation bonds.

RELATING TO PUBLIC SAFETY. Requires that any inmate transferred to any out-of-state correctional institution be subject to the continuing jurisdiction of Hawaii and authorizes the removal of the inmate from the correctional institution. Requires the Director of Public Safety to submit an annual public report with information related to Hawaii inmates, including statistics and Department procedures on inmate deaths and serious or violent incidents involving inmates.

RELATING TO LAW ENFORCEMENT. Prohibits state law enforcement agencies from complying with federal immigration detainers or honoring requests for non-public information unless specifically required to do so by a warrant signed by a judge or provisions of federal, state, or local law.

RELATING TO ORDERS FOR TREATMENT OVER OBJECTION. Authorizes psychiatric and medical treatment by administrative order despite a patient's objection for pretrial detainees or committed persons in the custody of the Department of Public Safety. Establishes criteria for issuing court or administrative order and the process to determine whether administrative order should be issued for psychiatric or medical treatment over the patient's objection. Effective 7/1/2018.

RELATING TO EMERGENCY MANAGEMENT. Requires each local television station to make emergency information that is provided in the audio portion of its video programming accessible to persons with hearing disabilities by using a method of closed or open captioning.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
