RELATING TO THE STATE ETHICS CODE. Clarifies State Ethics Code provisions on gifts disclosure statements, retention of financial disclosure statements, investigations, and training.

RELATING TO FINANCIAL DISCLOSURE STATEMENTS. Requires certain information on the financial disclosure statements deemed to be public records for non-paid volunteer members of state boards to be redacted.

RELATING TO STATE EMPLOYEES. Adds a definition of "intern" to the State Ethics Code and includes interns among state employees to whom the code applies.

RELATING TO THE HAWAII LABOR RELATIONS BOARD. Requires the Hawaii Labor Relations Board to adopt emergency rules if the Board finds that Hawaii's collective bargaining in public employment law, or the application thereof, is inconsistent with any federal or state law and the adoption of an emergency rule is urgently needed.

RELATING TO PUBLIC EMPLOYEES. Amends collective bargaining law to ensure that exclusive bargaining representatives retain the resources necessary to adequately represent public employees and remove economic incentive to free ride.

RELATING TO EMERGENCY RULES BY AGENCIES. Authorizes agencies to adopt specified emergency rules to lessen disruptions to prior practices caused from changes to federal law, Hawaii legislation, or court decisions.

RELATING TO OCCUPATIONAL SAFETY AND HEALTH. Requires the Hawaii Labor Relations Board to deliver its decisions and orders by hand, USPS mail with delivery confirmation, or electronically.

RELATING TO COLLECTIVE BARGAINING. Requires the Labor Relations Board to deliver its orders and decisions by hand, USPS mail using a delivery confirmation, or electronically. Extends the time to hold a hearing on a complaint from 40 to 90 days. Repeals the requirement for the State to pay for witness fees and to conduct an audit. Establishes a collective bargaining dispute resolution special fund.

RELATING TO COLLECTIVE BARGAINING. Allows a representative of each county council to be present as a nonvoting participant in negotiations with bargaining units if the relevant county has employees in the particular bargaining unit. Requires mayors to report collective bargaining unit negotiations to their respective county councils.

RELATING TO KEKAHA KAI STATE PARK. Appropriates funds for the employment of lifeguards and for life-saving equipment at Kua Bay.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

FAX: For testimony less than 5 pages in length, transmit to 808-586-6189 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
