RELATING TO WORKERS' COMPENSATION. Provides that a duly qualified physician or duly qualified surgeon selected and paid for by an employer to perform a medical examination on an employee relating to a work injury under workers' compensation shall be duly qualified to treat the injury being examined, possess medical malpractice insurance, and owe the same duty of care to the injured employee as to a traditional patient.

RELATING TO THE HAWAII EMPLOYER-UNION HEALTH BENEFITS TRUST FUND. Prohibits the Hawaii Employer-Union Health Benefits Trust Fund (Fund) from withholding any retroactive reimbursement payable after June 30, 2013, to a retired employee-beneficiary and qualified employee-beneficiary's spouse for an income-adjusted Medicare Part B premium based on the time in which the adjustment request is made to the Fund. Establishes notice requirements.

RELATING TO PUBLIC-PRIVATE PARTNERSHIPS. Establishes the Office of Public-Private Partnership and the position of State Public-Private Partnership Coordinator. Adds design-build-operate-maintain and design-build-finance-operate-maintain project delivery methods to the Procurement Code and related conditions and requirements.

RELATING TO EMPLOYMENT OPPORTUNITY. Appropriates funds to the Office of the Governor; the Department of Labor and Industrial Relations; the Department of Business, Economic Development, and Tourism; the Department of Human Resources Development; and the Department of Agriculture to collaboratively develop and implement solutions to assist dislocated workers and address the overall continued availability of gainful employment on the island of Molokai.

RELATING TO EDUCATION. Bars judicial review of Department of Commerce and Consumer Affairs' decisions on protests to the award of procurement contracts for student transportation or education facility construction. Requires parties who protest the award of a contract to pay attorney fees and costs resulting from the delay of the contract if the Department of Commerce and Consumer Affairs upholds the Chief Procurement Officer's decision denying the protest.

RELATING TO THE STRUCTURE OF GOVERNMENTAL AGENCIES. Transfers small boat harbors, boating, ocean recreation, and coastal areas programs from the Department of Land and Natural Resources back to the Department of Transportation.

RELATING TO LAW ENFORCEMENT. Establishes a law enforcement standards board for the certification of county police officers, state public safety officers, and employees of the departments of transportation and land and natural resources with police powers. Establishes the law enforcement standards board special fund. Appropriates funds.

RELATING TO EDUCATION. Directs the Department of Human Resources Development to provide University of Hawaii tuition grants to students who commit to future employment with the State. Appropriates moneys.

RELATING TO UNIVERSITY OF HAWAII PUBLIC-PRIVATE PARTNERSHIPS. Allows the University of Hawaii to enter into public-private partnerships and establish an Office of Strategic Partnerships and Development to specifically analyze, evaluate, recommend, coordinate, oversee, and manage public-private partnerships that would benefit the University of Hawaii.

RELATING TO STANDARDIZED TESTING. Limits the number of standardized tests a student shall take in a school year. Requires the board of education to conduct a statewide survey of school administrators and teachers to determine the time spent on preparing for standardized tests and the impact of preparation time on the quality of instruction.

RELATING TO CONTRACTORS. Authorizes specialty contractors to perform work outside the scope of their licenses when that work is subordinate to another contractor and directly related to and necessary for the project.

RELATING TO SPECIALTY CONTRACTORS. Requires the Contractors License Board to adopt rules to define "incidental and supplemental to the performance of work" and to set the percentage of a craft or trade in which a specialty contractor may engage without a license while performing work in a craft or trade for which the contractor is licensed.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
